What does the HOA do, and how and why do they do it, or HOA 101

Many homeowners don't really know what the HOA has to do, why they have to do it , and what they can and can't do. Lots of what is required is called out in the Las Colinas CC&Rs and our Rules and Regulations. Other requirements are specified by California Code. Still some other things were decided by votes of previous boards of directors. Some things we can't change, like California Code, Other things we can. But changes to CC&Rs are expensive because they require a large percentage of the homeowners to vote; and our experience shows that Las Colinas homeowners just won't return ballots. Even a ballot with the ABSTAIN box checked instead of YES or NO counts toward reaching quorum.  Maybe some of what follows will help to encourage homeowners to participate in the management of their HOA.

Why do we have an HOA?

When the developer established Las Colinas they made it a PRIVATE Planned Unit Development and set up the rules, a management organization with bylaws, and incorporated the management organization. The management organization was controlled by the developer until there were enough homeowners to take over. After 2008 the homeowners have chosen the team to manage the HOA by choosing the directors of the HOA in an election. Since our streets and retention basins no longer belong to the City of Indio or County of Riverside somebody has to take care of them. All the common property became the responsibility of the owners of the homes and lots in Las Colinas. By becoming private property we took over the responsibility of maintenance and repair of common property from the City of Indio and the County of Riverside. When you bought your home in Las Colinas you chose to take over the job that the City once had, for better or worse.   

 

The HOA tries to anticipate what repairs and maintenance and other expenses that are going to be needed and tries to have the money available when the bills come in for the work. If the money were not there, a SPECIAL ASSESSMENT would be required. The Las Colinas Board works very hard to be sure that SPECIAL ASSESSMENTS won't be necessary. The good side of all this is that we can all work together to take special care of our community and make it a nicer place to live and raise our families. That's why we all need to work with the Board of Directors in deciding what is best for Las Colinas. That includes the owners of rental property too. 

What: Insurance​

The Board of directors is required to be sure we have insurance. If anyone gets hurt on the COMMON PROPERTY, we could get sued. That means all the homeowners could get sued. Remember, it's your property, and it's not the city's property. If someone trips and falls, and they want to sue whoever owns the sidewalk or get hurt in the retention basin park, they are going to sue YOU the owner not the City of Indio. that is because as a homeowner you own a share of the street, sidewalk, gates and park.

HOA secures insurance to cover people working for the HOA and common property​. The Board of directors has a fiduciary responsibility to secure the proper insurance at the best price. It's complicated, because insurance issues are often quite technical and the laws we must meet are changing constantly. Board members attend lectures to keep current and read up on the latest insurance issues. 

What: Security Patrol​

The HOA sponsors a security service that patrols Las Colinas at random times seven days a week, and is available 24 hours a day when summoned by homeowners. 

Why Hire Professional Management

The Board of Directors has contracted with Personalized Property Managemnet (PPM) to provide financial and professional management for Las Colinas.  They are the contact point for day-to-day requests by homeowners, contractors, realestate interests, and directing requests to the HOA Board. They interface with the bank and provide financial reports to the board for approval. They handle communication to the homeowners, ane store all HOA records. If you have a financial issue with the HOA, contact PPM. IF the gate is broken, tell PPM.

What: Carriage Light

The HOA asks that we keep our Carriage‑Lights and Address‑Lights in good repair. If you haven’t checked them lately, you should inspect them after dark. The light sensor is high on the sidewall of the garage. Maybe it needs to be cleaned off. The new LED 9‑watt lamps will keep the electricity costs low and are easy to install.

The HOA expects lights to be working. Our developer chose to have fewer streetlights and to use our house-mounted carriage lights to provide added security for Las Colinas at a low cost. It's important for everyone to keep their carriage lights in good repair and to replace bulbs when necessary.
